These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Epoxy Designs LLC ("Epoxy Designs," "Company," "we," "us," or "our"), a limited liability company organized under the laws of the State of New Hampshire. These Terms govern your use of the Epoxy Designs website located at epoxydesigns.net (the "Website") and your engagement of our professional epoxy flooring installation and related services (the "Services"). By accessing or using our Website or engaging our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
1. Acceptance of Terms
By accessing, browsing, or otherwise using the Epoxy Designs website, submitting a request for an estimate, scheduling a consultation, or engaging our professional epoxy flooring services in any capacity, you expressly agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms, conditions, or policies referenced herein or provided to you in connection with a specific project.
If you do not agree with any provision of these Terms, you must immediately discontinue use of the Website and refrain from engaging our Services. Your continued use of the Website or Services following the posting of any changes to these Terms constitutes your acceptance of such changes.
Age Requirement
You must be at least eighteen (18) years of age to use our Website or engage our Services. If you are under the age of eighteen (18), you may only use our Website or engage our Services with the involvement and consent of a parent or legal guardian. By using our Website or engaging our Services, you represent and warrant that you meet this age requirement.
Authority to Bind
If you are accessing our Website or engaging our Services on behalf of a company, organization, partnership, or other legal entity, you represent and warrant that you have the full legal authority to bind that entity to these Terms. In such cases, "you" and "your" shall refer to and include that entity, and you personally represent that you are authorized to accept these Terms on behalf of that entity.

3. Free Estimates & Pricing
Free Consultations and Estimates
Epoxy Designs offers free on-site consultations and project estimates at no cost or obligation to the Client. During the consultation, our team will assess the condition of your concrete substrate, discuss your design preferences, review available flooring system options, and provide a preliminary pricing estimate based on the information gathered.
Estimate Validity and Binding Nature
All estimates provided by Epoxy Designs are non-binding and are intended for informational purposes only. Estimates are valid for a period of thirty (30) calendar days from the date of issuance. After the thirty (30) day period, estimates may be subject to revision based on changes in material costs, labor availability, or project scope. An estimate does not constitute a contract or a binding agreement to perform work.
Final Pricing and Contracts
Final pricing for all projects will be confirmed and documented in a written contract or formal project proposal. The written contract will detail the full scope of work, materials to be used, project timeline, total cost, payment terms, and any applicable warranty provisions. No work will commence until a written contract has been executed by both parties.
Price Adjustments
Prices quoted in estimates and proposals are subject to change due to fluctuations in the cost of raw materials (including epoxy resins, hardeners, pigments, aggregates, topcoats, and other consumables), changes in supplier pricing, and variations in labor costs. Epoxy Designs will make reasonable efforts to honor quoted prices but reserves the right to adjust pricing prior to contract execution if material costs change significantly.

Additional charges may apply for unforeseen conditions discovered during surface preparation or installation, including but not limited to:
In the event that unforeseen conditions are discovered, Epoxy Designs will promptly notify the Client, explain the additional work required, and provide a revised cost estimate before proceeding. The Client will have the option to approve the additional work or modify the project scope.
Sales Tax
All applicable state and local sales taxes will be added to the final project cost in accordance with the tax laws of the state in which the Services are performed. Tax rates and applicability vary by state and jurisdiction. The Client is responsible for all applicable taxes unless a valid tax exemption certificate is provided prior to project commencement.
4. Project Scheduling & Site Access
Site Access and Work Area Preparation
The Client must provide Epoxy Designs and its installation crew with full, unobstructed access to the designated work area for the entire duration of the project, including any necessary preparation, installation, and cure periods. Access must be available during normal business hours and, where applicable, during extended hours as agreed upon in the project contract.
Client Preparation Responsibilities
Prior to the scheduled start date of the project, the Client is responsible for ensuring the following conditions are met:
Weather and Environmental Conditions
The installation schedule is subject to weather conditions and material cure requirements. Epoxy flooring systems require specific temperature and humidity ranges for proper application and curing. The minimum ambient and substrate temperature for most epoxy installations is fifty degrees Fahrenheit (50°F / 10°C). Installations are generally not recommended when temperatures fall below this threshold or when excessive humidity is present, as these conditions can compromise adhesion, cure times, and the final quality of the flooring system.
HVAC and Climate Control
The Client must ensure that heating, ventilation, and air conditioning (HVAC) systems are fully operational and available for use during and after the installation process. Proper temperature and humidity control is critical for achieving optimal curing conditions and ensuring the longevity and performance of the installed flooring system. The Client shall maintain the HVAC system in accordance with any specific instructions provided by the Epoxy Designs installation team.
Scheduling Delays
Epoxy Designs will make every reasonable effort to adhere to the agreed-upon project schedule. However, delays may occur due to weather conditions, material availability, supplier lead times, or other factors beyond our control. In the event of a delay, Epoxy Designs will communicate promptly with the Client to reschedule at the earliest available date. Epoxy Designs shall not be held liable for any losses, costs, or damages resulting from scheduling delays.
5. Surface Preparation & Existing Conditions
Importance of Surface Preparation
All epoxy flooring installations require thorough and proper concrete surface preparation as a prerequisite for adhesion, performance, and longevity. Surface preparation is the single most critical factor in determining the success and durability of any resinous flooring system. Epoxy Designs utilizes professional-grade diamond grinding equipment, shot blasting, and other mechanical profiling methods to achieve the appropriate concrete surface profile (CSP) for each specific coating system.
Assessment of Existing Conditions
Pre-existing concrete defects and conditions will be assessed during the initial consultation and again at the commencement of surface preparation. These conditions may include, but are not limited to:
Pre-Existing Structural Defects
Epoxy Designs is not responsible for pre-existing structural defects in the concrete substrate, including but not limited to foundation settlement, structural cracking, slab heaving, or deterioration caused by age, environmental exposure, or improper original construction. While we will make every reasonable effort to address cosmetic and surface-level defects as part of the preparation process, epoxy coatings are surface treatments and do not repair or reinforce the structural integrity of the underlying concrete.
Moisture Vapor Testing and Mitigation
Moisture vapor emission testing (such as calcium chloride testing per ASTM F1869 or relative humidity testing per ASTM F2170) may be required prior to installation to assess moisture conditions in the concrete substrate. If testing reveals moisture vapor emission rates that exceed the acceptable limits for the specified coating system, moisture mitigation measures will be recommended. Moisture mitigation is performed at additional cost to the Client and will be detailed in a separate proposal or change order.
Existing Coating Removal
If the concrete substrate has existing coatings, sealers, paints, or adhesives that must be removed prior to the installation of the new epoxy system, this removal work will be performed at additional cost to the Client. The scope and cost of coating removal will depend on the type, thickness, adhesion strength, and area of the existing coating. Removal costs will be detailed in the project contract or a change order.
Concrete Strength Requirements
The concrete substrate must meet minimum compressive strength requirements to support an epoxy flooring system. Concrete that is too weak, porous, or deteriorated may not provide adequate adhesion or support for the coating. Epoxy Designs reserves the right to decline installation on substrates that do not meet the minimum requirements necessary for a successful installation.
Expansion and Control Joints
Expansion joints, isolation joints, and structural control joints will be honored and left exposed through the coating system. These joints serve a critical structural function in allowing the concrete slab to move, expand, and contract without cracking. Coating over expansion joints can lead to cracking and failure of the flooring system. These joints are not covered by the coating warranty.
Cosmetic Variations
Minor cosmetic variations in color, texture, sheen, and overall appearance are inherent characteristics of hand-applied resinous flooring systems and are not considered defects. These variations may include slight differences in metallic pigment flow patterns, flake or quartz aggregate distribution density, color shade variations between production batches, and surface texture differences between trowel-applied and roller-applied sections. Such variations are a natural result of the application process and contribute to the unique, custom character of each installation.
6. Project Scope & Change Orders
Scope of Work
All work performed by Epoxy Designs shall be limited to the scope of work expressly described in the written contract or formal project proposal. The contract will detail the specific areas to be coated, the flooring system to be installed, preparation methods, materials, and all other relevant project specifications. Any work not explicitly included in the written contract is outside the scope of the project.
Change Orders
Any modifications, additions, deletions, or changes to the original scope of work must be documented in a written change order signed by both the Client and an authorized representative of Epoxy Designs. Change orders will detail the specific changes requested, any impact on the project timeline, and any adjustments to the total project cost. Work on change order items will not commence until the written change order has been fully executed.
Impact on Timeline and Pricing
Change orders may result in adjustments to both the project timeline and the total project cost. The Client acknowledges that additional work, material changes, or scope modifications may extend the project duration and increase the overall price. Epoxy Designs will provide the Client with a clear explanation of any timeline or cost impacts before the change order is executed.
Verbal Agreements
Verbal agreements, instructions, or promises made by any party — whether by the Client, Epoxy Designs employees, contractors, or agents — are not binding and shall not be enforceable. All agreements relating to the scope of work, pricing, timeline, materials, and any other project terms must be documented in writing and signed by both parties to be valid and enforceable.
7. Cure Times & Post-Installation Care
Cure Time Requirements
The Client must strictly observe all cure time requirements communicated by the Epoxy Designs installation team. Cure times are critical to achieving the full performance characteristics of the installed flooring system. Typical cure time guidelines are as follows:
Actual cure times may vary based on the specific product system installed, temperature, humidity, ventilation, and other environmental factors. The Epoxy Designs team will provide specific cure time instructions tailored to your project.

Liability for Premature Use
Epoxy Designs shall not be held liable for any damage, defects, discoloration, delamination, or other issues caused by the Client's failure to observe the prescribed cure times and post-installation care instructions. Premature use of the floor — including walking on the surface, placing objects, driving vehicles, or cleaning before the specified cure period has elapsed — constitutes a breach of these Terms and voids any applicable warranty on the affected areas.
Post-Installation Care Instructions
Detailed care and maintenance instructions will be provided to the Client at the completion of each project. These instructions will include recommended cleaning methods, products to use and avoid, maintenance schedules, and guidelines for preserving the appearance and performance of the installed flooring system. Following these instructions is essential for maximizing the lifespan and maintaining the appearance of your epoxy floor.
8. Warranty
Workmanship Warranty
Epoxy Designs LLC provides a workmanship warranty on all flooring installations performed by our crew. The workmanship warranty covers defects in installation that result in peeling, delamination, bubbling, or adhesion failure that is directly and solely attributable to errors in the installation process by Epoxy Designs. The specific warranty period for each project will be detailed in the individual project contract.

The workmanship warranty does NOT cover damage, defects, or deterioration caused by or resulting from any of the following:
Product Manufacturer Warranties
Product manufacturer warranties are separate from the Epoxy Designs workmanship warranty and are provided directly by the manufacturer of the products used in your installation. Where applicable, manufacturer product warranties will be passed through to the Client. Epoxy Designs makes no representations or guarantees regarding the scope, duration, or terms of any manufacturer warranty. Claims under manufacturer warranties must be directed to the respective manufacturer in accordance with their warranty terms and procedures.
Warranty Claims Process
All warranty claims must be submitted in writing to Epoxy Designs within thirty (30) calendar days of the discovery of the alleged defect. Warranty claims should include a detailed description of the issue, the location of the affected area, photographs documenting the condition, and the approximate date the issue was first noticed. Warranty claims may be submitted via email to sales@epoxydesigns.net or by contacting our office at (978) 267-5448.
Upon receipt of a warranty claim, Epoxy Designs will schedule an inspection of the affected area at a mutually convenient time. Epoxy Designs will inspect the floor, assess the nature and cause of the reported issue, and determine, at its sole and reasonable discretion, whether the issue falls within the scope of the workmanship warranty. If the claim is approved, Epoxy Designs will repair or re-coat the affected area at no additional cost to the Client. If the claim is denied, Epoxy Designs will provide a written explanation of the denial and, where applicable, offer a paid repair option.
9. Limitation of Liability
To the fullest extent permitted by applicable law, the total aggregate liability of Epoxy Designs LLC, its owners, members, managers, employees, agents, contractors, and affiliates, arising out of or in connection with any project, contract, service, or these Terms of Service, shall not exceed the total contract price of the specific project giving rise to the claim.
In no event shall Epoxy Designs LLC, its owners, members, managers, employees, agents, contractors, or affiliates be liable for any of the following, whether arising from contract, tort, negligence, strict liability, or any other legal theory:
The Client is solely responsible for the removal and replacement of all fixtures, trim, baseboards, door sweeps, thresholds, appliances, and any other items that may be affected by the flooring installation. Epoxy Designs shall not be held liable for the cost of removal, reinstallation, or replacement of such items unless expressly included in the project scope of work.
10. Payment Terms
Deposit and Scheduling
A deposit is required to secure your project on the Epoxy Designs installation schedule. The specific deposit amount will be detailed in your individual project contract or proposal. The deposit is applied toward the total project cost and reserves your installation date. No project will be scheduled until the required deposit has been received and the project contract has been signed by both parties.
Progress Payments
For larger projects or projects with extended timelines, progress payments may be required at designated milestones during the installation process. Progress payment amounts, milestones, and due dates will be detailed in the project contract. The Client agrees to make all progress payments on time and in full in accordance with the contract terms.
Final Payment
The final payment balance is due in full upon completion of the installation and prior to the final walkthrough sign-off. The Client agrees to inspect the completed work promptly and remit final payment upon satisfactory completion. Completion is defined as the point at which the flooring system has been fully installed in accordance with the project contract specifications.
Accepted Payment Methods
Accepted payment methods will be specified in the individual project contract. Epoxy Designs reserves the right to modify accepted payment methods at any time.
Late Payments and Interest
Any payment not received by the due date specified in the project contract shall be considered past due. Past-due balances are subject to a late payment charge of one and one-half percent (1.5%) per month (eighteen percent [18%] per annum) on the outstanding balance, or the maximum rate permitted by applicable law, whichever is less. Late payment charges begin accruing on the first day following the payment due date and continue until the balance is paid in full.
Collection Costs
In the event that Epoxy Designs is required to engage collection efforts, legal proceedings, or other measures to recover past-due amounts, the Client shall be responsible for all costs of collection, including but not limited to reasonable attorney fees, court costs, filing fees, collection agency fees, and any other expenses incurred in the recovery of the outstanding balance.
Suspension of Work
Epoxy Designs reserves the right to suspend or halt all work on any project if payments are not received in accordance with the agreed-upon payment schedule. Work will resume upon receipt of all past-due amounts, including any applicable late payment charges. Epoxy Designs shall not be held liable for any delays, additional costs, or damages resulting from a suspension of work due to non-payment by the Client.
Retention of Title
All materials, products, and supplies delivered to or installed at the project site remain the property of Epoxy Designs LLC until full and final payment for the project has been received. Upon receipt of full payment, ownership of installed materials transfers to the Client. Until full payment is received, Epoxy Designs retains the right to reclaim any materials that have been delivered but not yet permanently installed.
11. Cancellation & Rescheduling Policy
Client Cancellation
The Client may cancel a scheduled project subject to the following terms based on the notice period provided prior to the scheduled installation start date:
All cancellation requests must be submitted in writing via email or other documented communication to Epoxy Designs. The cancellation date is determined by the date on which Epoxy Designs receives the written notice, not the date it was sent.
Client Rescheduling
One (1) reschedule of the project start date is permitted at no additional charge, provided that the Client provides at least forty-eight (48) hours' advance notice prior to the originally scheduled start date. The rescheduled date will be subject to availability on the Epoxy Designs installation calendar.
Subsequent reschedule requests may incur a rescheduling fee to compensate for disruption to the installation schedule and any associated costs. The rescheduling fee amount will be communicated to the Client prior to confirming the new date.
Cancellation by Epoxy Designs
Epoxy Designs reserves the right to cancel or postpone a scheduled project due to adverse weather conditions, safety concerns, material availability issues, supply chain disruptions, or any other circumstances that may compromise the quality or safety of the installation. In the event of a cancellation initiated by Epoxy Designs, the Client's deposit will be fully refunded or applied to a rescheduled date, at the Client's election.
12. Intellectual Property
Website Content Ownership
All content displayed on the Epoxy Designs website, including but not limited to text, written copy, photographs, images, graphics, illustrations, videos, page layouts, design elements, logos, icons, and software code, is the exclusive property of Epoxy Designs LLC or its content licensors and is protected by United States and international copyright, trademark, and intellectual property laws. Unauthorized reproduction, distribution, modification, display, or use of any website content without the prior written consent of Epoxy Designs LLC is strictly prohibited.
Photography of Completed Installations
Epoxy Designs retains the right to photograph, video record, and document all completed installations. These photographs and recordings may be used by Epoxy Designs for portfolio presentations, website content, social media posts, advertising materials, marketing campaigns, print materials, trade show displays, and any other promotional or commercial purposes. All photographs and recordings taken by Epoxy Designs or its representatives remain the exclusive property of Epoxy Designs LLC.
Opt-Out of Photography
Clients who wish to opt out of having their completed installation photographed or used for marketing purposes may do so by providing written notice to Epoxy Designs prior to the commencement of the installation. Opt-out requests must be submitted in writing (email is acceptable) and received before the scheduled start date of the project. Verbal opt-out requests will not be honored.
Trademarks and Brand Elements
The Epoxy Designs name, logo, taglines, and all associated brand elements are trademarks of Epoxy Designs LLC. These trademarks may not be used, reproduced, or displayed without the prior written permission of Epoxy Designs LLC. Any unauthorized use of our trademarks or brand elements is strictly prohibited and may result in legal action.
Product names, brand names, and trademarks referenced on our website or in our marketing materials are the property of their respective manufacturers and are used for identification and descriptive purposes only. Epoxy Designs does not claim ownership of any third-party trademarks.
13. Client Representations & Responsibilities
By engaging the Services of Epoxy Designs LLC, the Client represents, warrants, and agrees to the following:

The Client agrees to indemnify, defend, and hold harmless Epoxy Designs LLC, its owners, members, managers, officers, employees, agents, contractors, and affiliates from and against any and all claims, demands, actions, causes of action, lawsuits, judgments, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees and court costs) arising out of or resulting from:

15. Force Majeure
Neither Epoxy Designs LLC nor the Client shall be held liable for any delay, failure to perform, or interruption of service resulting from causes beyond the reasonable control of the affected party (a "Force Majeure Event"). Force Majeure Events include, but are not limited to:
The party affected by a Force Majeure Event must notify the other party as promptly as reasonably possible of the nature of the event and its anticipated impact on the project schedule. The project timeline shall be extended by a period equal to the duration of the Force Majeure Event. If a Force Majeure Event continues for a period exceeding ninety (90) calendar days, either party may terminate the project contract upon written notice, and any deposits or payments made will be refunded on a pro rata basis for work not yet performed.
16. Dispute Resolution
Good-Faith Negotiation
In the event of any dispute, disagreement, claim, or controversy arising out of or relating to these Terms of Service, any project contract, or the Services provided by Epoxy Designs LLC, the parties agree to first attempt to resolve the matter through good-faith negotiation. The complaining party shall provide written notice of the dispute to the other party, including a detailed description of the issue and the desired resolution. The parties shall have thirty (30) calendar days from the date of the written notice to resolve the dispute through direct negotiation.
Mediation
If the dispute cannot be resolved through good-faith negotiation within the thirty (30) day period, the parties agree to submit the dispute to non-binding mediation before a mutually agreed-upon mediator in the State of New Hampshire. The costs of mediation, including mediator fees and venue costs, shall be shared equally between the parties. Each party shall bear its own attorney fees and costs associated with the mediation process. The mediation shall take place in Massachusetts at a location mutually agreed upon by the parties.
Litigation
If mediation fails to resolve the dispute, either party may pursue the matter through litigation in the state or federal courts located within the State of New Hampshire. The prevailing party in any litigation shall be entitled to recover its reasonable attorney fees, court costs, and expenses from the non-prevailing party.
17. Governing Law
These Terms of Service, all project contracts, and any disputes arising out of or related to the Services provided by Epoxy Designs LLC shall be governed by, construed under, and enforced in accordance with the laws of the State of New Hampshire, without regard to its conflict of law principles or provisions.
The Client irrevocably consents to the exclusive personal jurisdiction and venue of the state and federal courts located in the State of New Hampshire for any and all actions, suits, or proceedings arising out of or relating to these Terms, any project contract, or the Services provided by Epoxy Designs LLC. The Client waives any objection to jurisdiction or venue in these courts, including any objection based on inconvenient forum.
18. Severability
If any provision, clause, or portion of these Terms of Service is found to be invalid, illegal, void, or unenforceable by a court of competent jurisdiction, such finding shall not affect, impair, or invalidate the remaining provisions of these Terms, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties, or if modification is not possible, it shall be deemed severed from these Terms.
19. Entire Agreement
These Terms of Service, together with the individual project contract or proposal executed for each specific project, the Privacy Policy, and any written change orders or amendments, constitute the entire agreement between the Client and Epoxy Designs LLC with respect to the subject matter hereof. This agreement supersedes all prior and contemporaneous negotiations, discussions, representations, understandings, proposals, and agreements, whether written or oral, between the parties relating to the same subject matter.
No waiver of any provision of these Terms shall be effective unless made in writing and signed by an authorized representative of the waiving party. The failure of either party to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it at a later time. A waiver of any particular breach shall not constitute a waiver of any subsequent or different breach.
20. Changes to Terms
Epoxy Designs LLC reserves the right to modify, update, revise, or replace these Terms of Service at any time and at its sole discretion. Changes will be effective immediately upon posting to this page on our website. The "Last Updated" date at the top of this page will be revised to reflect the date of the most recent changes.
Your continued use of the Epoxy Designs website or engagement of our Services following the posting of any changes to these Terms constitutes your acceptance of and agreement to the updated Terms. It is your responsibility to review these Terms periodically to stay informed of any changes.
For material changes that substantially affect the rights or obligations of active clients with ongoing projects, Epoxy Designs will make reasonable efforts to provide direct notice via email or other communication to affected clients. However, the posting of updated Terms on this page shall constitute sufficient and effective notice for all purposes.
